What is Basic Salary?
Basic salary is the fixed monthly wage stated in your employment contract, excluding:
- Housing allowance
- Transportation allowance
- Bonuses and commissions
- Overtime payments
- Any other variable compensation
Continuous Service
Service is considered continuous if there are no breaks in employment. Authorized leave (annual, sick, maternity) does not break continuity. Unpaid leave may or may not be included depending on employer approval.
Free Zone Variations
DIFC (Dubai International Financial Centre) and ADGM (Abu Dhabi Global Market) have their own employment regulations that may differ from federal UAE labor law. Employees in these zones should consult their specific free zone employment regulations.
Article 44 - Gross Misconduct
If an employee is terminated under Article 44 for gross misconduct (e.g., fraud, assault, safety violations), they may forfeit their gratuity entitlement entirely.
